ACTION: Final rule. ----------------------------------------------------------------------- SUMMARY: The Office of Personnel Management (OPM) is issuing a final rule to transfer lead agency responsibility for the Birmingham, Alabama, Federal Wage System (FWS) wage area from the Department of Veterans Affairs (VA) to the Department of Defense (DOD) for pay- setting purposes. This change would recognize the fact that DOD is now the major employer of FWS employees in the Birmingham, Alabama, FWS wage area and has the capability to assume the responsibility as lead agency for the next full-scale survey in January 1996. SUPPLEMENTARY INFORMATION: On February 1, 1995, OPM published a proposed rule (60 FR 6041) to transfer lead agency responsibility for the Birmingham, Alabama, FWS wage area from the Department of Veterans Affairs to the Department of Defense. The proposed rule provided a 30- day period for public comment. The only comment OPM received supported the proposed rule. Therefore, the proposed rule is being adopted as a final rule. Regulatory Flexibility Act I certify that these regulations will not have a significant economic impact on a substantial number of small entities because they will affect only Federal agencies and employees.
