Jason Foster

Jason Foster serves as the Office of Personnel Management’s (OPM) Associate General Counsel, where he oversees legal matters related to compensation, benefits, services, and products. Mr. Foster joined the Office of the General Counsel at the Office of Personnel Management in October of 2016.

Prior to his arrival at OPM, Mr. Foster served for eight years as an Associate Deputy General Counsel in the Office of General Counsel for the Department of Defense. In that capacity, Mr. Foster worked on legal and policy matters related to the criminal proceedings of individuals accused of domestic and international acts of terrorism and on civil litigation related to the operation of the military detention facility at Guantanamo Bay, Cuba. His work included federal and military trial and appellate litigation, administrative due process for non-DoD employee security clearance adjudication, personnel matters, Hatch Act compliance, and matters involving the DoD and the International Committee of the Red Cross (ICRC).

Prior to his service in DoD OGC, Mr. Foster worked as a senior attorney advisor to the Convening Authority for Military Commissions. While there, he provided legal research on military and international criminal procedure and was involved in the development and drafting of the Rules of Procedure and Evidence as well as the Regulation for Trial by Military Commission.

Mr. Foster began his legal career working on workers’ compensation and professional malpractice matters for the firm of Hansen, McClintock and Riley in Des Moines, Iowa. He is a graduate of Drake Law School (2005) and The University of Iowa (1998). He is admitted to the bar in Virginia.
