Your disability annuity was terminated because your reported earned income for a previous year met or exceeded your 80% restored to earning capacity limit. If you believe your 2015 earned income was below your 80% restored to earning capacity limit, mail a letter of request for a restoration of disability annuity package to Retirement Surveys and Students, U. S. Office of Personnel Management, 1900 E St., NW, Washington, DC 20415, ATTN: Room 2416 or you may fax your request to the attention of Artis Walton or James Alston at (202)606-0022.

If the FERS Supplement was previously terminated due to excess wages in 2017, then the retiree would need to wait to have their 2018 tax return and associated W2s. If they filed a joint tax return, then we would need to have the spouse’s W2s as well to cross confirm the reported comingled wage amount on the tax return. Once the annuitant has submitted a copy of their 2018 tax return and associated W2s, then we will review to determine if their reported wages decreased enough from the prior to deem them eligible for a FERS Supplement. If they are found eligible, then their FERS Supplement will be reinstated as of the effective month of Jan 2019.

If your 2015 earnings met or exceeded the earnings limit for that year, your disability annuity will be terminated due to restoration of earnings capacity effective July 1 (you will not be paid an August 1, 2016, payment for July). If you do not have earned income in 2016 or if your earned income in 2016 does not meet or exceed your earnings limit, and if you meet medical requirements, if applicable, your benefit can be restored effective January 1, 2017.
