A court order may expressly award all or a portion of your employee annuity to a former spouse in a decree of divorce, annulment of marriage, legal separation, or court-approved settlement agreement. A court order may also expressly award all or a portion of your employee annuity in a final judgement for physically, sexually, or emotionally abusing a child. The amount of an employee annuity payable to a former spouse must be stated as a fixed amount, a percentage or fraction of your employee annuity, or by a formula with a readily apparent value. The amount of your employee annuity payable to another person cannot exceed the amount of your net annuity.
A court order may also expressly require OPM to pay all or part of a refund of your retirement deductions to another person or may block OPM from paying you a refund of your retirement deductions in a lump-sum credit after you have applied for this benefit. However, a court order may only block OPM from paying a lump-sum credit if the order directs OPM not to pay the refund and grants a survivor annuity or a portion of your annuity to a legally separated current spouse or former spouse.
