Frequently Asked Questions Benefits for LGBT Federal Employees and Annuitants

A federal employee is going to retire in the next couple of years. The employee has a partner and currently has blood relatives as Thrift Savings Plan (TSP) beneficiaries. Can this TSP beneficiary be maintained if the employee marries a partner?

OPM does not administer TSP benefits. The experts at the Federal Retirement Thrift Investment Board provided this answer:

“Yes. TSP death benefits are paid based on a valid Designation of Beneficiary Form (TSP-3) on file with the TSP record keeper at the time of the participant’s death. If there isn’t a valid designation on file with the TSP record keeper, the death benefit will be paid in accordance with the statutory order of precedence.”
